1.2. These Terms and Conditions (“Terms”) govern access to and use of the Site and the information society services provided through it (Article 3 of the Bulgarian Electronic Commerce Act).

1.3. By accessing, viewing or using any feature of the Site, you (the “User”) declare that you are at least 18, have read and accept these Terms. If you do not agree, please stop using the Site.

2. Definitions

“Content” — all texts, data, charts, images, logos, video/audio, code and databases on the Site.

“Forms” — electronic enquiry/meeting forms, an appropriateness questionnaire and a newsletter subscription form.

3. Nature of the information. No individual advice or offer

3.1. The Site’s Content is informational and promotional. Nothing on the Site constitutes (i) individual or general investment advice, (ii) a recommendation within the meaning of EU or national law, or (iii) an offer, invitation, or inducement to enter into a transaction in financial instruments or crypto-assets.
3.2. We do not provide individual advice through the Site. Individual portfolios are structured only after an appropriateness questionnaire and a personal meeting to establish an individual investment mandate.

3.3. Past results and simulations do not guarantee future returns. Crypto-assets are high risk and total loss of invested capital is possible. Seek independent professional advice before making a decision.

The following are prohibited: (a) circumventing technical measures; (b) introducing malicious code; (c) automated content extraction (scraping) without express written consent; (d) actions affecting the normal operation, security, or reputation of the Site; and (e) use that circumvents applicable law.

5.3. Belayer may temporarily restrict or suspend access for maintenance, updates, force majeure or breach of these Terms.

6. Site features

6.1. The Site is informational and does not support user accounts/authentication.
6.2. When completing Forms, you must provide accurate, complete and up-to-date information. You are responsible for the consequences of inaccurate or incomplete data. You can unsubscribe from the newsletter via the link in each email.

8.3. The Belayer logo is a registered trademark. Nothing on the Site grants a licence to use it without Belayer's express written consent.

9. Information accuracy, external links and disclaimer of warranties

9.1. We make reasonable efforts to ensure accuracy and currency, but the Content is provided “as is” and “as available,” without express or implied warranties of fitness, accuracy, completeness, uninterrupted availability, or compatibility.

9.2. The Site may link to external sites; Belayer does not control or assume responsibility for their content, policies or security.

10. Limitation of liability

10.1. To the fullest extent permitted by law, Belayer, its managers, employees, and affiliates shall not be liable for any direct, indirect, consequential, punitive, or other damages, lost profits, expenses, or losses (including losses from crypto-asset transactions) arising from or related to access to, use of, or inability to use the Site, the Content, external links, technical failures, viruses, incompatibility, or human error.

11. Indemnification

The user agrees to indemnify and defend Belayer against third-party claims arising from a breach of these Terms, applicable law or third-party rights when using the Site.

12. Changes to the Site and Terms

12.1. Belayer may amend the Content, functionality and/or these Terms at any time. The current version is available on this page with a last-updated date.
